Users are informed that the following Terms and Conditions apply by the mere use of or access to any of the pages, web and mobile applications, software and applications in general that make up the ohanafintech.com portal (hereinafter, jointly and indistinctly, the "Portal"), and therefore we will understand that you accept them and agree to be bound by them. If you do not agree with these Terms and Conditions, you must refrain from accessing or using the Portal.
OHANA by DGLLPS, S.A.P.I. de C.V., with registered office in Mexico City, and/or OHANA FIN, LLC, with registered office in Nevada, USA, as well as their subsidiaries, parent companies, related parties and affiliates (hereinafter, jointly and indistinctly, the "Company") reserve the right to modify the content of the Portal at their discretion at any time, without prior notice. The User, understood as any person who uses or accesses the Portal by means of a computer and/or any communication device (hereinafter the "User"), agrees not to use devices, software or any other means intended to interfere with the activities and/or operations of the Portal, or with the databases and/or information contained therein.
Access to or use of the Portal implies the User’s full and unconditional adherence to these Terms and Conditions. Through the Portal, the User may consult information and, where appropriate, contract and/or use the financial services made available by the Company (the "Services and Content"). The Company shall have the right, at any time and without prior notice, to deny, restrict or condition the User’s access to the Portal, in whole or in part, as well as to modify the Services and Content. The User acknowledges that not all Services and Content will be available in all geographic areas, and that some may require the corresponding prior contracting and/or registration. The use of the Services and Content will always be under the sole responsibility of the User, who must use them in accordance with the functionalities allowed on the Portal, the applicable legal provisions and good practices.
The User may not place hyperlinks to the Portal without the Company’s prior written authorization, nor use, reproduce or distribute the Services and Content on the User’s or third-party sites or pages without the Company’s express consent. It is also prohibited to use software, devices or any other means intended to interfere with the operation of the Portal, its databases or the information contained therein, as well as to prevent or hinder other Users’ access to and use of the Portal. Likewise, it is prohibited to use the Portal for unlawful purposes, contrary to morality, good customs, third-party rights or the applicable laws in Mexico, in the United States of America or in any other country from which the User accesses.
The Company offers loans exclusively, which will be subject to specific requirements, a credit assessment and the execution of the corresponding agreement. Submitting an application does not guarantee the approval of a loan, as approval will at all times depend on the Company’s internal policies and the results of the credit assessment performed. The User understands and accepts that the approval, amount, term and conditions of loans may vary in accordance with the Company’s criteria, the applicable regulations and the information provided by the User.
The intellectual and industrial property rights relating to the Services and Content, including without limitation the distinctive signs, trade names, logos, designs, software, databases, texts and information contained on the Portal, are the exclusive property of the Company or of third parties who have authorized their use. The User acknowledges that no intellectual or industrial property rights are acquired by mere access to or use of the Portal, and that at no time shall such access be construed as an authorization or license to use the Services and Content for purposes other than those established in these Terms and Conditions.
The Company offers the Services and Content with a commercially reasonable level of skill and care; however, it does not warrant that the Portal will be free from interruptions, errors, computer viruses or other harmful components. The Portal is provided "as is" and "as available," and the User expressly acknowledges and agrees that use is at the User’s own risk. Neither the Company nor its suppliers shall be liable for any damages that the User may suffer as a result of errors, inaccuracies, technical failures, temporary interruptions or periodically made modifications to the Services and Content. The Company’s maximum liability, in all cases, shall be limited to the amount actually paid by the User for the contracted services.
The User may cancel the Services and Content contracted on the Portal at any time, at the User’s sole discretion and without additional liability. However, payments made for interest, fees, finance charges or other amounts arising from loans will not be refundable, except as expressly agreed in the corresponding agreement. The User acknowledges and agrees that cancellation of access to the Portal will not extinguish obligations in force arising from loan agreements already executed.
If certain services offered on the Portal require a subscription or registration, the User must have a valid payment method associated with the User’s account and will be subject to the terms and conditions of the corresponding payment platform.
The Portal may contain links to third-party websites, as well as goods and services offered by such third parties. The inclusion of this information does not imply recommendation, guarantee, sponsorship or approval by the Company. The User acknowledges that the products and services marketed on third-party sites are the exclusive responsibility of their providers or sellers, and that the Company does not maintain an employment, corporate or agency relationship with them. Consequently, the Company shall not be liable for any damages, losses or disputes arising from the contracting, consumption, delivery or use of goods and services provided by third parties.
The Company undertakes to keep confidential the confidential information it receives from the User, in accordance with the applicable legal provisions in Mexico and the United States of America. The Company shall have no obligation to keep confidential any information provided by the User that is not of such nature or that is publicly available, as well as information that must be disclosed by legal provision or by order of a competent authority.
By using the Portal, the User expressly authorizes the Company to use, publish, reproduce, disclose, publicly communicate and transmit information that is not confidential, under the terms provided by applicable law, including without limitation the Federal Law on Protection of Personal Data Held by Private Parties, the Federal Consumer Protection Law and related provisions.
The User accepts that the Portal may use cookies and similar technologies to collect browsing information and improve the User’s experience. A cookie is a data file stored on the User’s device when accessing the Portal and may contain information such as the User’s identification and the history of pages visited. The User may disable cookies in the browser settings, but acknowledges that doing so may limit the proper functioning of the Portal or prevent access to some of its features.
All information that the Company collects from the User will be treated with absolute confidentiality and in strict adherence to the applicable legal provisions in Mexico and the United States of America. The processing of personal data will be governed by the Privacy Notice available on the Portal, which forms an integral part of these Terms and Conditions.
The User shall at all times be responsible for maintaining the confidentiality of the User’s access keys and any other credentials associated with the User’s account on the Portal. Any transaction carried out through the User’s account will be presumed to have been performed by the User.
By creating an account on the Portal, the User declares, under penalty of perjury, that the User is at least eighteen years of age or the age of majority in the User’s jurisdiction. The User further acknowledges being solely responsible for the activities carried out through the User’s account and that the User has read and accepts these Terms and Conditions and the Privacy Notice.
The Company shall have the right to modify these Terms and Conditions at any time without prior notice to the User. Changes will take effect upon their publication on the Portal. Consequently, the User must periodically review the current Terms and Conditions.
For Users who access and use the Portal from Mexico, Mexican federal laws shall apply and the courts of Mexico City shall have jurisdiction. For Users who access and use the Portal from the United States of America, the laws of the State of Nevada shall apply and the courts of that State shall have jurisdiction. The User expressly waives any other forum or jurisdiction that may correspond by reason of the User’s present or future domicile or for any other cause.
